Amorus Privacy Policy

This Privacy Policy applies when Creative Banter Inc. or any of its corporate subsidiaries, parents, or affiliates (also referred to as "we", "us", and "our" here) collects, uses, or discloses information about any person in connection with the use of any website, application, API, or service (collectively, our "services") offered by us.

Creative Banter Inc. is a messaging company. Our messaging app is known as Amorus. We help users connect and share messages (text, audio, and visual), pictures, and games with known partners in the Amorus app (often referred to as Flames).

When you use these services, you'll share some information with us. We want to be clear about the information we collect, how we use it, whom we share it with, and the controls we give you to access, update, and delete your information.

That information is contained in this Privacy Policy. If you have questions about anything in our Privacy Policy, just contact us at support@amorus.net.

If you do not agree with our policies and practices regarding your privacy as set out here, your choice is not to use our services. By accessing or using the services, you agree to this Privacy Policy. This policy may change from time to time; your continued use of the services after we make changes is deemed to be acceptance of those changes, so please check this policy periodically for updates.

Children

We require all users of our services to be natural persons of age 18 or older. Any user under 18 is in violation of our Terms of Service and this Privacy Policy, must stop using our services immediately, and will have their ability to access our services revoked immediately by us in our complete discretion.
Information We Collect

We collect some information from and about you as you use our services, including information:

  • By which you may be personally identified, such as name, e-mail address, telephone number, or any other information we collect that is defined as personal or personally identifiable information under an applicable law ("personal information");
  • That is about you but individually does not identify you; and/or
  • About your internet connection, the equipment you use to access our services, and your usage details.

There are two basic sources where we get this information:

  • From you, when you provide it to us.
  • When you use our services.
Here's a little more detail on each of these categories.

Information You Provide

When you interact with our services, we collect information that you provide to us. For example, our services require you to set up an account, so we need to collect a few details about you, such as your email address, pronouns, and date of birth. We may also ask you to provide us with some additional information that will be visible on our services, such as a profile picture.

Of course, you'll also provide us whatever information you send through our services, such as messages and photos. Keep in mind that the users who receive your messages, or any other content from within Amorus may be able to save that content or copy it outside the app in ways that we cannot control. For example, we cannot stop another user from saving or sharing what you send. So, the same common sense that applies to the internet at large applies to our services: Don't send messages or share content that you wouldn't want someone to save or share.

When you communicate with us in any other way, we'll collect whatever information you volunteer or that we need to resolve your question.

Information We Get When You Use Our Services

When you use our services, we collect information about which of those services you've used and how you've used them. Here are the types of information we collect when you use our services:

  • Usage Information. We collect information about your activity through our services. For example, we may collect information about:
    • how you communicate, such as your Flames' usernames, the time and date of your communications, the number of messages you exchange, which Flames you message with the most, and your interactions with those messages (such as when you open a message).
    • how you interact with our services, such as when you are online, which games you play, how often you play them, what game elements you like or dislike

  • Device Information. We collect information from and about the devices you use. For example, we collect:
    • information about your hardware and software, such as the hardware model, operating system version, device memory, unique application identifiers, unique device identifiers, language, battery level, and time zone;
    • information about your wireless and mobile network connections, such as service provider, IP address, and signal strength

  • Camera and Photos. Many of our services require us to collect images and other information from your device's camera and photos. For example, you can't upload photos from your camera roll or take photos to send in the app unless we can access your photo library or camera.

  • Information Collected by Cookies and Other Technologies. Like most online services and mobile applications, we may use cookies and other technologies, such as web beacons, web storage, and unique advertising identifiers, to collect information about your activity, browser, and device. You can usually remove or reject browser cookies through the settings on your browser or device.

  • Log Information. We also collect log information when you use our website, such as:
    • details about how you've used our services;
    • device information, such as your web browser type and language;
    • access times;
    • pages viewed;
    • IP address;
    • identifiers associated with cookies or other technologies that may uniquely identify your device or browser; and
    • pages you visited before or after navigating to our website.
How We Use Information

We use this information to create a set of services that we work to improve. Here are ways we use your info:

  • develop, operate, improve, deliver, maintain, and protect our products and services.

  • send you communications, including by email. For example, we may use email to respond to support inquiries or to share information about our products, services, and promotional offers that we think may interest you.

  • monitor and analyze trends and usage.

  • enhance the safety and security of our products and services.

  • verify your identity and prevent fraud or other unauthorized or illegal activity.

  • use information we've collected from cookies and other technology to enhance our services and your experience with them.

  • enforce our Terms of Service and other usage policies and comply with legal requirements.

How We Use Information

We use this information to provide our services to you, including:

  • To develop, operate, improve, deliver, maintain, and protect our products and services.
  • To send you communications and notices about your account, including by email. For example, we may use email to respond to support inquiries or to share information about our products, services, and promotional offers that we think may interest you.
  • To allow you to participate in interactive features of our services, including when you share personal information with other persons, such as your Flames.
  • To monitor and analyze trends and usage.
  • To enhance the safety and security of our products and services.
  • To verify your identity and prevent fraud or other unauthorized or illegal activity.
  • To use information we've collected from cookies and other technology to enhance our services and your experience with them.
  • To enforce our Terms of Service and other usage policies and comply with legal requirements.
  • In any other way we may describe when you provide the information.
  • For any other purpose with your consent
How We Share Information

We may share information about you in the following ways

  • With other users. We may share the following information with your Flames:
  • information about you, such as your username, invite code, and profile picture.
  • information about how you have interacted with our services, such as if you are online, whether you have opened a message, or information about game interactions. For instance, Fantasy Swipe tiles that you marked yes, Chat Sparks messages that have appeared in the shared chat, whether you have solved a Jigsaw.
  • content you send.

  • With third parties. We may share information about you with service providers who perform services on our behalf.

  • We may also share information about you with business partners that provide services and functionality on our services. For instance, sharing your invite code to enable sending it to someone in your contacts. We do not access your contacts.

  • We may share information about you, such as device and usage information, to help us and others prevent fraud.

  • We may share information about you for legal, safety, and security reasons. We may share information about you if we reasonably believe that disclosing the information is needed to:
    • comply with any valid legal process, governmental request, or applicable law, rule, or regulation.
    • investigate, remedy, or enforce potential Terms of Service violations.
    • protect the rights, property, or safety of us, our users, or others.
    • detect and resolve any fraud or security concerns.

We may also share with third parties that provide services to us or perform business purposes for us, so long as any information we share is aggregated, non-personally identifiable, or de-identified.
How Long We Keep Your Information

User content sent in Amorus is stored encrypted on our servers, until deleted by the user.

We store your basic account information, like your user name, email address, profile picture, and list of Flames, until you ask us to delete them.

If you ever decide to stop using Amorus, you can delete your account in the app. You can also ask us to delete your account at support@amorus.net.

We cannot promise that deletion will occur within a specific timeframe. There may be legal requirements to store your data and we may need to suspend those deletion practices if we receive valid legal process asking us to preserve content, if we receive reports of abuse or other Terms of Service violations, or if your account or content created by you is flagged by our automated systems for abuse or other Terms of Service violations. Finally, we may also retain certain information in backup for a limited period of time or as required by law.
Control Over Your Information & Rights of Access

We want you to be in control of your information, so we provide you with the following tools.

  • Access, Correction, and Portability. You can access and edit your basic account information in our app. You can request your data directly from support@amorus.net.
  • Deletion. If you ever want to delete your account, you can do so in the app. You can also delete a relationship in the app, which will also delete the relationship and its content from the other Flames' account (this will happen when the app is next connected to the cloud, unless there are valid legal reasons to delay the deletion).
You also have the right to object to our use of your information. With many types of data, we've provided you with the ability to simply delete it if you don't want us processing it anymore. You can do these things in the app. If there are other types of information you don't agree with us processing, you can contact us at support@amorus.net.

California Privacy Rights

During the preceding 12 months, we have collected, used, and shared the categories of personal information described in this Privacy Policy. Your receipt of this policy serves as your notice of collection, and you acknowledge and agree that you have received such notice at or before the point at which you provide us the personal information collected from you. We do not sell your personal information.

California residents may have certain rights to access and delete their personal information and to request transparency about our privacy practices. If you would like to access or delete your information, or otherwise exercise your rights under the California Consumer Privacy Act, please see follow the procedures identified for exercising control over your information, above.

When we receive a request from you regarding your personal information, we may verify it by requesting information sufficient to confirm your identity, including by asking you for additional information. Consistent with California law, if you choose to exercise your rights, we will not charge you different prices, provide different quality of services, or discriminate against you in any way for exercising your rights, unless those differences are permitted by law. If you would like to use an agent registered with the California Secretary of State to exercise your rights, we may request evidence that you have provided such agent with power of attorney or that the agent otherwise has valid written authority to submit requests to exercise rights on your behalf.

Users in the European Union

If you're a user in the European Union, you should know that Creative Banter Inc. is the controller of your personal information. Here is some additional information we would like to bring to your attention:
Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. The safety and security of your information also depends on you. When you choose a username and password for access to certain parts of our services, you are responsible for keeping this information confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted in connection with our services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures our services employ.

International Transfers

We are based in the United States, and our services are offered to persons located in the United States. As such, information about you will be transferred to, and processed in, the United States, which may not be your country of residence. Your country of residence may have data protection laws that are different to the laws of the United States and, in some cases, may not be as protective.

Revisions to the Privacy Policy

We reserve the right to update this Privacy Policy at our discretion.
